Terms and Conditions
Last updated: [DATE OF PUBLICATION]
1. Agreement
These terms are an agreement between [REGISTERED LEGAL NAME OF COMPANY] ("we", "us") and the school or institution that registers to use the Face Attendance System (the "Service"). The person who registers the school confirms that they are authorised to accept these terms on the school's behalf. By registering or using the Service, the school accepts these terms and our Privacy Policy.
2. The Service
The Service provides:
- Student registration and attendance marking using face recognition in a web browser.
- Optional location verification, which only accepts attendance from within campus areas set by the school.
- Attendance records, reports and PDF exports.
- Backup and sync of student and attendance data to the school's own Google Drive.
- Fee management: fee structures, concessions, payments, receipts, dues and reports.
We may add, change or remove features. We will give reasonable notice before removing a feature the school relies on.
3. School accounts and approval
- A school registers using its Google account. Registration is a request. The account is not active until we approve it.
- We may approve or reject a registration request at our discretion and will give a reason where practical.
- Each school account has a student limit. Registering students beyond that limit requires our approval.
- The school is responsible for all activity under its accounts and must keep usernames, passwords and its Google account secure.
- The school must tell us promptly if it believes an account has been accessed without permission.
4. School responsibilities
The school decides what data to put into the Service and is responsible for it. In particular, the school must:
- Have a lawful basis to collect and process every student's data, including face photos and face recognition templates.
- Obtain verifiable consent from a parent or guardian before registering any student under 18, where required by law, and keep a record of that consent.
- Tell students, parents and guardians how attendance is recorded, including the use of face recognition and location checks.
- Delete a student's data when it is no longer needed or when consent is withdrawn.
- Keep the data it enters accurate and up to date.
- Maintain its own Google account and Google Drive storage, which hold the school's student data and backups.
5. Acceptable use
The school must not, and must not allow anyone to:
- Use the Service for any purpose other than managing its own students' attendance and fees.
- Register people who are not its students or staff, or use face recognition on anyone without the required consent.
- Attempt to bypass location verification, student limits, approval checks or login controls.
- Access, or try to access, another school's data.
- Interfere with, overload or reverse engineer the Service, except where the law allows it.
- Use the Service in a way that breaks any law.
6. Your data
The school owns the data it enters into the Service. Most student data, photos and attendance records are stored in the school's browsers and its own Google Drive. School account details, campus locations, blocked attendance logs and fee data are stored on our servers, as described in the Privacy Policy.
We process the school's data only to provide and support the Service, to keep it secure, and as required by law. On request, we will export or delete the school's data held on our servers, subject to any legal obligation to keep it.
7. Accuracy and records
- Face recognition and device location are not perfect. A student may be missed, matched to the wrong record, or blocked because of a poor location signal.
- The school must review attendance records and correct mistakes. Attendance records produced by the Service should not be the only basis for disciplinary or legal decisions.
- Fee amounts, dues and reports are calculated from the fee structures, concessions and payments the school enters. The school is responsible for checking them before relying on them or sharing them with parents.
- Payments recorded in the Service are records only. The Service does not currently collect or transfer money.
8. Charges
[DESCRIBE PRICING: e.g. free trial period, subscription fee per school or per student, billing cycle, taxes, late payment, refunds. If the Service is free, say so.]
9. Availability
We aim to keep the Service available but do not guarantee it will be uninterrupted or free of errors. Attendance can continue offline on a device that has already loaded the app. Data syncs to Google Drive when the device is back online. We may carry out maintenance, and will try to schedule it outside school hours.
The school should keep its Google Drive backups enabled. We are not responsible for data lost because browser storage was cleared on a device that was not backed up.
10. Third-party services
The Service depends on services run by others, including Google (sign-in, Drive, Sheets), map and address providers, and content delivery networks. Their availability and terms are outside our control. The school's use of its Google account is governed by Google's terms.
11. Suspension and termination
- The school may stop using the Service at any time and ask us to close its account.
- We may suspend or close a school account if the school breaks these terms, does not pay charges that are due, or if we are required to by law. Where practical, we will give notice and a chance to fix the problem first.
- After closure, the school keeps the data in its own Google Drive. Data on our servers will be handled as described in the Privacy Policy.
12. Limitation of liability
[LEGAL REVIEW REQUIRED: liability cap, exclusion of indirect losses, and any warranties. Do not publish without a lawyer's wording.]
13. Governing law
These terms are governed by the laws of India. The courts at [CITY, STATE] have exclusive jurisdiction over any dispute arising from them.
14. Changes to these terms
We may update these terms. We will change the date at the top of this page and notify school administrators of significant changes at least [NUMBER] days before they take effect. Continuing to use the Service after that date means the school accepts the updated terms.
